An Act relative to the cannabis control commission's authority regarding host community agreements.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 3(d) of Chapter 94G of the General Laws is hereby amended by inserting after the first paragraph the following paragraph:-

No obligation beyond the payment of 3 per cent of the gross sales of the marijuana establishment over five years, however characterized, shall be enforceable, whether or not inserted prior to the effective date hereof. Intra-company transfers of marijuana by a cultivator or product manufacturer from the municipality where it is produced for retail sale in another municipality shall not be deemed sales for purposes of this section.
