An Act relative to unused leave time.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Subsection (d) of section 31A of chapter 29 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended  by inserting after the figure “150E”, in line 47, the following words:- or subsection (e).

SECTION 2. Said section 31A of said chapter 29, as so appearing, is hereby amended by inserting after subsection (d) the following subsection:-

(e) No cabinet member appointed pursuant to section 17A of chapter 6, chief executive, director, president, vice president or other senior officer of a quasi-governmental agency, quasi-public agency or quasi-independent public authority including but not limited to the Massachusetts Port Authority, or president of a community or state college or university, who retires or terminates employment for any reason and who has accrued unused sick-leave credits shall be paid or entitled to any payment, contribution or other compensation by the commonwealth for unused sick-leave credits accrued during any period of employment by the commonwealth in which he or she was not subject to a collective bargaining agreement.   Nothing in this subsection shall be construed to restrict or amend the terms of any collective bargaining agreements or other contractual terms.  This subsection shall not apply to active members of the military.

SECTION 3.  Sections 1 and 2 shall apply to sick-leave time accrued on or after the effective date of this act.

SECTION 4. The personnel administrator shall adopt rules to implement the requirements of this act.
