An Act authorizing the city of Somerville to impose impact fees for any development project for the purposes of funding the Green Line extension.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1. The City of Somerville is hereby authorized, by zoning ordinance, to impose impact fees for any development project within a half mile of any station on the Green Line Extension for the purposes of funding the Green Line Extension. The ordinance shall specify the dollar amount of the impact fee, and types of uses, and geographic areas to which the ordinance shall apply. The impact fee may initially be set at a maximum of $2.50 per square foot, and may be indexed to the Consumer Price Index (CPI) inflation rates.  Any impact fee shall comply with the following: (1) it shall have a rational nexus to an impact created by the development; and (2) it shall apply to properties which will benefit from the construction of the Green Line Extension.  The ordinance shall specify the terms of when a developer is responsible for payment to the City.

The authorization of Somerville’s ordinance shall expire on or before June 31, 2059.

Section 2. This act shall take effect upon its passage.
