Chapter 140 of the General Laws is hereby amended by inserting after section 205A the following section:-
Section 205B. Any amusement device, as that term is defined in section 205A, powered by electricity that is sold in the primary, or secondary market, shall be equipped, updated or retrofitted to meet today’s safety standards for amusement devices, before any such device may be operated by the purchaser for use by the general public.
All amusement devices utilizing centripetal or centrifugal force, regardless of the age of the device, shall be required to have a modern, passenger safety restraining system in place that secures the passenger to the interior of the amusement device’s carriage, cage, seat, enclosure, or internal structure, to prevent injury to the passenger in the event of a loss of consciousness or physical dexterity during the operation of the amusement device. No amusement device utilizing centripetal or centrifugal force in its operation that fails to contain such a passenger safety restraining system shall be certified or allowed to operate for entertainment purposes by the general public.
Any violation of this section shall be punishable by a fine of no less than $10,000.00 per violation to be assessed by the office of public safety and inspections of the division of professional licensure.
