An Act relative to firearms.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to establish forthwith the regulation of firearms, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 131E of chapter 140 of the General Laws is hereby amended by adding the following subsection:-
(c) A person who uses a license to carry firearms or a firearm identification card to purchase a firearm, rifle or shotgun for the unlawful use of another or for resale to or giving to an unlicensed person shall be punished by imprisonment in the state prison for not more than two and one-half years, or for not more than 18 months in a jail or house of correction. Prosecutions commenced under this subsection shall neither be continued without a finding nor placed on file. A conviction of a violation of this section shall be reported immediately by the court to the licensing authority that issued the license or firearm identification card. The licensing authority shall immediately revoke the license or firearm identification card pursuant to section 129B or section 131 and no license shall be issued to a person convicted of a violation of this section after the date of the revocation of the license or firearm identification card.
SECTION 2. Section 59 of chapter 284 of the Acts of 2014 is hereby amended by striking out the third paragraph.
