SECTION 1. Notwithstanding any general or special law to the contrary, including but not limited to chapter 30B of the General Laws, the Town of Marion is authorized to transfer to the care, custody and control of the Select Board of the Town of Marion a parcel of land described in section 2 currently held by the Town of Marion Conservation Commission for conservation purposes; provided, that upon such transfer, the Select Board of the Town of Marion is authorized to enter into an agreement with A. & J. Boat Corporation to convey a fee interest in a part, portion or all of the aforesaid parcel of conservation land as the Select Board of the Town of Marion deems necessary or appropriate, and the Select Board of the Town of Marion is further authorized to require as conditions of said conveyance that the fee shall be merged with an adjacent lot owned by A. & J. Boat Corporation and shall not be a separate buildable lot.
SECTION 2. The parcel of land referred to in section 1 is Town of Marion Conservation Commission property located on Boat Works Lane in Marion and further identified as Parcel 41A on a Plan of Land prepared for “the Trust of Public Land” recorded in Plymouth County Registry of Deeds in Plan Book 39, Page 24, containing 17,487 square feet.
SECTION 3. In consideration for the transfer, conveyance and change of use of part, a portion, or all of said parcel of land as described in section 1, the Select Board of the Town of Marion shall acquire by purchase, gift or eminent domain and shall dedicate for conservation purposes under the care, custody and control of the Town of Marion Conservation Commission pursuant to section 8C of chapter 40 of the General Laws and Article 97 of the Amendments to the Constitution of the Commonwealth, the land and property owned or controlled by [A. and J. Boat Corporation], said parcel located off Point Road and further identified as Lot 17 on Marion Assessor’s Map 7A, containing 4.22 acres (183,823 square feet), more or less.
SECTION 4. This Act shall take effect upon its passage.
