An Act authorizing the city of Fitchburg to employ Kevin D. Roy as fire chief beyond the statutory retirement age.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, Kevin D. Roy may be appointed and may continue to serve in the position of the Fire Chief of the City of Fitchburg Fire Department until the date of his retirement or until the date he is relieved of his duties by the Mayor or June 30, 2020, whichever occurs first; provided, however, that he is mentally and physically capable of performing the duties of his office. The City of Fitchburg, at its own expense, may require Kevin D. Roy be examined by an impartial physician designed by the City to determine his mental and physical capability. No further deductions shall be made from the regular compensation of Kevin D. Roy under Chapter 32 of the General Laws for any service subsequent to January 31, 2020, and upon retirement, he shall receive a superannuation retirement allowance equal to that which he would have been entitled had he retired on January 31, 2020.

SECTION 2. This act shall take effect upon its passage.
