SECTION 1. Notwithstanding chapter 30B of the General Laws or any other general or special law to the contrary, the town of Shutesbury, acting by and through its select board, may transfer or convey, by lot or otherwise, the property described in section 2, currently owned by the town in exchange for acquiring the property described in section 3. The property described in section 3 shall be used by the town, in part, for a well for certain abutting properties in the town of Shutesbury, including the highway garage, located at 57 Leverett Road in the town of Shutesbury.
SECTION 2. The land to be conveyed by the town of Shutesbury is described as lot 22 on the town of Shutesbury assessor’s map B, located at Oak Knoll drive and lots 27 and 28 on the town of Shutesbury assessor’s map B, located on Great Pines drive in the town of Shutesbury, and in judgments recorded with the Franklin county registry of deeds in (i) book 1651, page 145; (ii) book 16541, page 142; and (iii) book 3792, page 283, all together containing approximately 1/3 acre of land.
SECTION 3. The land to be acquired by the town of Shutesbury is described as lots H-12, H-13 and a portion of H-30, known as the Mary Clark lot on town of Shutesbury assessor’s map ZH-12, containing approximately 10 acres of land; provided, however that the conveyance shall be subject to an easement reserved by the grantor to allow the grantor to access the remaining land of the grantor.
SECTION 4. This act shall take effect upon its passage.
