An Act authorizing the town of Mashpee to convey certain town owned conservation land to Mark and Donna Lopez.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. (a) Notwithstanding any general or special law to the contrary, the town of Mashpee may convey the parcel of land dedicated by the town for conservation purposes and described in subsection (b) to Mark and Donna Lopez. In consideration for the conveyance, the town shall acquire the parcel of land described in subsection (c) for open space, conservation and passive recreation purposes.
(b) The portion of land that may be conveyed by the town pursuant to subsection (a) is shown as “Portion of Lot 3-B to be Conveyed to Lopez” on a plan prepared for Mark and Donna Lopez, titled “Approval Not Required Plan of Land in Mashpee, Massachusetts” by Cape & Islands Engineering on April 13, 2017 and updated on April 29, 2019. Said plan is on file with the town clerk. The parcel is a portion of the land acquired by the conservation commission of the town of Mashpee in a deed recorded in the Barnstable registry of deeds in book 10931, page 39, and consists of 3.72 acres, more or less.
(c) The portion of land that shall be acquired by the town pursuant to subsection (a) is shown as “Portion of Parcel B to be Conveyed to Town” on a plan prepared for Mark and Donna Lopez, titled “Approval Not Required Plan of Land in Mashpee, Massachusetts” by Cape & Islands Engineering on April 13, 2017 and updated on April 29, 2019. The parcel is a portion of the land acquired by Mark and Donna Lopez in a deed recorded in the Barnstable registry of deeds in book 3183, page 272, and consists of 3.72 acres, more or less.
SECTION 2. This act shall take effect upon its passage.
