SECTION 1. The Lynn water and sewer commission may use portions of the land known as McManus field in Neptune Boulevard park in the city of Lynn for combined sewer overflow control, including construction, installation, repair, maintenance and operation of a pump station facility and pipelines for the purpose of transporting and storing storm water. The parcel of land is further described as follows:
Being a portion of the land on Commercial street in the city of Lynn, described in a deed recorded with the Southern Essex district registry of deeds in book 6192, page 45, currently held for park purposes described in an agreement recorded with the Southern Essex district registry of deeds in book 32810, page 302;
Beginning at a point in the easterly sideline of Commercial street, said point being 518.37 feet southerly from the point of curvature at the southeast corner of Commercial street and Neptune boulevard, thence turning and running;
N 64º 20ʹ 20" E for a distance of 140.12 feet to a point, thence turning and running;
S 25º 39ʹ 40" E for a distance of 196.80 feet to a point in the northerly sideline of the Massachusetts Bay Transportation Authority commuter rail right-of-way, thence turning and running;
S 57º 30ʹ 45" W for a distance of 141.11 feet along said right-of-way to a point in the easterly sideline of Commercial street, thence turning and running;
N 25º 48ʹ 28" W for a distance of 125.02 feet along said easterly sideline of Commercial street to a point, thence turning and running;
N 25º 27ʹ 22" W for a distance of 88.56 feet again along said easterly sideline of Commercial street to the point of beginning.
The resulting parcel described has an area of 28,784 square feet, more or less.
SECTION 2. As consideration for the change of use of the land described in section 1, the city of Lynn shall acquire 72,330 square feet, more or less, of the land of the city of Lynn, from the West Lynn National Little League, Corporation, as described in the Southern Essex district registry of deeds in book 4518, page 162. The city shall dedicate the land for park purposes. The land is further described as follows:
Beginning at a point that is the northwesterly corner of land now or formerly of Michael T. and Cheryl A. Ryan, thence running;
N 47º 36ʹ 58" W for a distance of 31.76 feet to a point, thence turning and running;
S 50º 57ʹ 13" W for a distance of 55 feet, more or less, to a point on the shoreline of the Saugus river, thence turning and running;
Northerly and easterly by the shoreline of the Saugus river for a distance of 841 feet, more or less, to a point in the northerly sideline of Avon street, a paper street, thence turning and running;
S 13º 30ʹ 03" E for a distance of 70.5 feet, more or less, to a point, thence turning and running;
By a curve to the right of radius 50.00 feet a distance of 49.68 feet to a point, thence turning and running;
S 43º 25ʹ 42" W for a distance of 239.38 feet to a point, thence turning and running;
S 44º 16ʹ 58" E for a distance of 24.77 feet to a point, thence turning and running;
S 43º 25ʹ 32" W for a distance of 240.89 feet to the point of beginning.
The parcel described has an area of 72,330 square feet, more or less.
The parcel described is also shown as a portion of map 19, block 307, parcel 24 on the assessors’ maps for the city of Lynn.
