An Act establishing an au pair commission.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to forthwith provide for an au pair commission, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. There shall be a special commission, known as the au pair commission, to make an investigation and study the United States Department of State au pair exchange visitor program as it relates to sections 190 and 191 of chapter 149 of the General Law.

The commission shall consist of the following 11 members: the house and senate chairs of the joint committee on labor and workforce development, who shall serve as co-chairs; 1 person to be appointed by the speaker of the house of representatives; 1 person to be appointed by the president of the senate; the attorney general or designee: 1 person to be appointed by the Matahari Women Workers' Center; 1 person to be appointed by Greater Boston Legal Services, Inc.; 1 person to be appointed by the Massachusetts AFL-CIO; 1 person to be appointed by parent organization Hand in Hand; 1 person to be appointed by the Au Pair Families of Massachusetts; and 1 person to be appointed by agreement of Sponsor Agencies designated by the United States Department of State to conduct an au pair exchange program in Massachusetts.

The commission shall examine the impact of state policies and regulations, and of the decision in Capron v. Office of Attorney Gen. of Massachusetts, 944 F.3d 9 (1st Cir. 2019), on the au pair exchange program. The commission shall hold its first meeting not later than 30 days after the effective date of this act and may hold additional public meetings, fact-finding hearings and other public forums as it considers necessary.  The commission shall submit a report of its review and its recommendations, if any, together with drafts of legislation necessary to carry those recommendations into effect, by filing the same with the clerks of the house of representatives and the senate not later than December 6, 2020.
