By Messrs. McMurtry of Dedham and Donato of Medford, a petition (subject to Joint Rule 12) of Paul McMurtry, Paul J. Donato and others relative to room and board costs for au pairs under certain provisions of the domestic workers rights law.  Labor and Workforce Development.

An Act relative to room and board costs for au pairs.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to establish forthwith a room and board deduction for au pair employers, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Subsection (a) of section 190 of chapter 149 of the General Laws is hereby amended by inserting before the definition of “Domestic worker” the following definition:-

“Au pair”, an au pair participant who has been granted a J-1 visa solely for participation in the federal Department of State-designated exchange visitor program governed by 22 CFR section 62.31.

SECTION 2. Said section 90 of said chapter 149 is hereby further amended by inserting after subsection (h) the following subsection:-

(h ½) Notwithstanding subsection (f), (g) and (h), an employer may deduct from the payment to an au pair an amount for lodging, food and beverages not exceeding 40% of weekly wages owed.  

SECTION 3. This act shall take effect on December 2nd, 2019.
