SECTION l. Notwithstanding any general or special law to the contrary, the city of Woburn may use approximately 3.162 acres of land located between Main street and Forest Park road for the siting of a fire station. The parcel is bounded and described as follows: beginning at the southwestern corner of the parcel, on the easterly side of Main street at land now or formerly of Warren J. Sullivan; thence running N 10 41' 14" W, 334.80 feet along the easterly sideline of Main street to a point; thence running again by the easterly sideline of Main street N 10 30' 02" W, 153.24 feet to a point; thence turning and running N 62 32' 42" E, 180.76 feet to a point; thence turning and running N 59 41' 57" E, 37.28 feet to a point; thence turning and running S 24 56' 29" E, 183.00 feet to a point; thence turning and running S 84 56' 29" E, 100.00 feet to a point; thence turning and running S 01 33' 31" W, 190.00 feet to a point; thence turning and running S 36 59' 13" W, 206.22 feet to a point; thence turning and running S 70 45'16" W, 159.00 feet to the point of beginning. The parcel is a portion of land acquired by the city for park purposes, conveyed to the city by deed dated October 4, 1890 and recorded with the Middlesex south registry of deeds in book 2000, page 584. The parcel is shown on an exhibit plan of land entitled "Forest Park Location Main Street Woburn, Massachusetts" dated November 14, 2019, drawn by the city of Woburn engineering department and is on file with the clerk of the city. The remainder of parcel shall continue to be held for park purposes pursuant to Article 97 of the constitution.
SECTION 2. As a condition of the authority granted in section l, the city of Woburn shall transfer the care, custody, management and control of a portion of land currently held for general municipal purposes and comprising 3.183 acres of land, more or less, to the recreation commission to be used solely for active or passive park and recreational uses including but not limited to, community gardens, trails, noncommercial youth and adult sports and park, playground or athletic field purposes; provided, however, that recreational use of the land shall not include horse or dog racing or the use of the land for a stadium, gymnasium or similar structure. The parcel is the southerly portion of land conveyed to the city of Woburn by deed dated August 14, 2010 and recorded with the Middlesex South registry of deeds in book 55177, page 397 and is shown on an exhibit plan of land entitled "Hurld – Wyman School Location Lowell Street – Wyman Street Woburn, Massachusetts" dated November 14, 2019 drawn by the city of Woburn engineering department, on file with the clerk of the city. The parcel contains 3.183 acres of land and is more particularly described as follows: beginning at the southeastern corner of the parcel, on the northerly side of Wyman street, at the southwest comer of land now or formerly of Michael Lowry; thence running N 16 22' 35" W, 151.93 feet to a point at the northwest corner of said Lowry land; thence continuing on the same course 78.16 feet to a point; thence turning and running N 71 42' 13" W, 173.23 feet to a point; thence turning and running N 01 41' 07" E, 30.56 feet to a point; thence turning and running N 64 55' 24" W, 153.90 feet to a point; thence turning and running N 34 17' 55" W, 44.73 feet to a point; thence turning and running S 73 18' 37", 64.18 feet to a point; thence turning and running S 83 12' 02" W, 69.02 feet to a point; thence turning and running S 16 24' 39" E, 305.62 feet to a point; thence turning and running S 16 00 50" E, 115.72 feet to a point on the northerly sideline of Wyman Street; thence running by said sideline of Wyman Street on a curve having a radius of 1043.28', 57.67 feet to a point; thence continuing along the sideline of Wyman street N 86 57' 10" E, 347.80 feet to the point of beginning.
SECTION 3. As a further condition for the authority granted in section l, the city of Woburn shall limit the use of the farmstand located on the parcel referenced in section 2 to park and recreational uses only; and shall maintain in perpetuity the state of the art stormwater best management practices and limited impact development infrastructure that were designed into the adjacent construction of the Hurld-Wyman elementary school specifically to protect the pond water quality, groundwater quality and surrounding environment as shown on the stormwater grading and drainage plan filed on February 24, 2015 with the conservation commission of the city in support of the notice of intent for work to be performed impacting bordering land subject to flooding and land located within the 100 foot buffer zone of riverfront area, which work is subject to Massachusetts stormwater standards as promulgated by the department of environmental protection, a copy of which is on file with the city clerk.
SECTION 4. This act shall take effect upon its passage.
