An Act relative to affordable housing in the town of Dartmouth.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. (a) Notwithstanding any general or special law to the contrary, the Dartmouth housing authority may lease a portion of the land located at 1 Anderson way in the town of Dartmouth to Partners in Housing, LLC for a term of up to 99 years and upon such terms and conditions as the housing authority shall determine to be in the authority’s best interests for the purpose of the development, construction and operation of affordable housing units in the town of Dartmouth. The parcel is described in book 1754, page 483 of the Bristol county southern district registry of deeds, and was purchased by the Dartmouth housing authority on January 3, 1978. The consideration of said lease shall be $1.
(b) Notwithstanding any general or special law to the contrary but subject to paragraphs (a), (b) and (g) of section 16 of chapter 30B of the General Laws, the authority may, without soliciting proposals, negotiate terms and enter into a lease pursuant to subsection (a) directly with Partners in Housing, LLC. Said lease shall provide for the development, construction and operation of a multi-family residential dwelling consisting of 4 independent living units and 4 congregate units to be operated by Partners in Housing, LLC, in conjunction with the Dartmouth housing authority and the department of mental health.
(c) If the property described in subsection (a) is no longer used by the lessee as a multi-family affordable housing dwelling or if the lessee can no longer meet its obligations under said lease, the property shall immediately revert back to the authority to be used for affordable housing.
SECTION 2. This act shall take effect upon its passage.
