By Representative Parisella of Beverly and Senator Lovely, a joint petition (accompanied by bill, House, No. 4863) of Jerald A. Parisella and Joan B. Lovely (with the approval of the mayor and city council) that the city of Beverly be authorized to lease a certain parcel of land in said city currently held by the Beverly Harbor Management Authority for park and recreational purposes.  Municipalities and Regional Government.  [Local Approval Received.]

An Act relative to 1 Water Street in Beverly.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary the city of Beverly may lease all or a portion of the parcel of land described in section 2 currently held by the Beverly Harbor Management Authority for park and recreational purposes as the city deems necessary or appropriate a part, portion or all of the property located at 1 Water Street, Beverly, Massachusetts as the City deems necessary or appropriate, for the purpose of the operation of a restaurant as a public amenity and recreation along the city’s waterfront. Any future disposition of the parcel described in section 2 shall be subject to Article 97 of the Amendments to the Constitution.

SECTION 2.  The parcel of land to be leased in section 1 is described in a deed dated June 28, 1996 and recorded in the southern essex district registry of deeds, book 13634 and page 510.

SECTION 3. Notwithstanding any general or special law to the contrary, a lease executed pursuant to section 1 shall be in conformance with the urban self-help program project agreement executed by the commonwealth, the city, and the Beverly Harbor Management Authority recorded with the southern essex district registry of deeds, book 13634 and page 505, on June 28, 1996, as amended by project agreement amendment number 1 recorded with the southern essex district registry of deeds, book 33038 and page 548, on December 26, 2013 and by project agreement amendment Number 2 recorded with the southern essex district registry of deeds, book 36381 and page 507, on December 5, 2017.

SECTION 4. This act shall take effect upon its passage.
