An Act relative to an agricultural deed restriction in the town of Westborough.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Subsection (a) of Chapter 195 of the acts of 2018 is hereby amended by inserting after the words “page 230”, the following:- “on all or a portion of the premises described in said deed.”

SECTION 2.  Said chapter 195 is hereby further amended by striking the first sentence of subsection (b) and inserting in place thereof, the following:- “The consideration to be paid for the release authorized in subsection  (a) shall be the difference between the fair market unrestricted value of the property, or the portion thereof being released from the restriction and reverter if less than the entire parcel or the value of the proposed use, whichever is greater, and the agricultural fair value  as determined by an independent appraisal commissioned by the commissioner.”
