An Act authorizing the town of Stow to take easements and rights of way for the reconstruction of the Box Mill Road bridge.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. (a) Notwithstanding any general or special law to the contrary, the board of selectmen of the town of Stow may take easements and rights of way for the reconstruction of the Box Mill road bridge on a portion of the parcel of land shown as lot 2B on the town of Stow assessors’ map R22 , comprising not more than 20,000 square feet, on Brookside avenue owned by the Jean F. Lord Trust, described in a deed recorded in the Middlesex South registry of deeds in book 64351, page 49 and a conservation restriction held by the town of Stow, by and through its conservation commission, and the Stow Conservation Trust, Inc. recorded in the Middlesex South registry of deeds in book 71231, page 327.

(b) As a condition of the conveyance authorized in subsection (a), the town of Stow shall convey a parcel of land on Hudson road comprising approximately 1.15 acres, shown as parcel 66 on the town of Stow assessors’ map R01 and described in an instrument of taking recorded in the Middlesex South registry of deeds in book 12383, page 112 to the conservation commission of the town of Stow and dedicate said parcel to be preserved in a natural condition and used for conservation and passive recreation; provided, that the town shall record a deed in the Middlesex South registry of deeds conveying said parcel to the conservation commission of the town of Stow and placing said parcel under the protection of Article 97 of the Amendments to the Constitution.

SECTION 2. This act shall take effect upon its passage.
