An Act authorizing the Massachusetts Water Resources Authority to release easements upon certain real property in the town of Stoneham.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1.  Notwithstanding any general or special law to the contrary, but subject to subsection (d) of section 9 of chapter 372 of the acts of 1984, the Massachusetts Water Resources Authority is hereby authorized to release or relocate three easements upon a certain parcel of land in the Town of Stoneham owned or formerly owned by Langwood Commons, LLC as described in section 2.

Section 2.  The three easements that may be released or relocated by the Massachusetts Water Resources Authority in section 1 upon a certain parcel of land located in the Town of Stoneham owned or formerly owned by Langwood Commons, LLC are more particularly shown as “water Easement (WE-1)”, “AE-8”, and “Proposed 25’ Utility Easement” on Lot L on a plan recorded as Plan No. 1364 of 2007 in the Middlesex South Registry of Deeds. 

Section 3.  In consideration for the release or relocation of the three easements by the Massachusetts Water Resources Authority described in section s 1 and 2, Langwood Commons, LLC and/or Alta Langwood, LLC shall release four easements and agree to reduce the square footage and/or alter the configuration of a fifth easement upon a certain parcel of land located in the Town of Stoneham owned by the Massachusetts Water Resources Authority.  The four easements to be released by Langwood Commons, LLC and/or Alta Langwood, LLC are more particularly shown as “Water Easement (WE-1)”, “AE-8”, “Proposed 25’ Utility Easement”, and “DE-7” on Lots M and N on a plan recorded as Plan No. 1364 of 2007 in the Middlesex South Registry of Deeds.  The fifth easement wherein Langwood Commons, LLC and/or Alta Langwood, LLC agree to reduce the square footage from approximately 80,000+/- sq. ft. and/or alter its configuration, as more particularly shown as “DE-1” on Lots M and N on a plan recorded as Plan No. 1364 of 2007 in the Middlesex South Registry of Deeds, which when reduced shall be consistent with as easement of size of approximately 53,256+/- sq. ft. as more particularly shown as the Proposed Easement Area on a draft plan entitled “Massachusetts Water Resources Authority – Easement Plan of Land – Spot Pond Water Storage Facility, Woodland Drive, Stoneham, MA” dated August 15, 2018.
