An Act relative to the prohibition of the transfer or use of glyphosate in the Commonwealth.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 1.
a) No person, firm, partnership, association, limited liability company or corporation shall distribute, sell, offer for sale or use glyphosate or any products containing glyphosate within the Commonwealth of Massachusetts.
b) For the purposes of this section, glyphosate shall mean a synthetic compound that is a non-selective systemic herbicide, also known as N-(phosphonomethyl) glycerin with a chemical formula of C3H8NO5P.
c) The Department of Environmental Protection is authorized to promulgate such rules and regulations as it shall deem necessary to implement the provisions of this section.
Section 2.
This act shall take effect one year after it shall have become a law; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date is authorized and directed to be made and completed on or before such effective date.
Section 3.
Any person, firm, partnership, association, limited liability company or corporation who violates any provision of this chapter, or any regulation, order, license or approval issued or adopted thereunder: (a) shall be punished by a fine of not more than twenty-five thousand dollars, or by imprisonment for not more than two years in a house of correction, or both, for each such violation; or (b) shall be subject to a civil penalty not to exceed twenty-five thousand dollars for each such violation.
