An Act creating a special commission to study the equity of chapter 21J and 21O.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  There shall be established a special commission to study the equity of Chapters 21J and 21O.  The commission shall investigate and study how third party property owners are reimbursed as the result of a negligent petroleum release.  Said study shall include the development of protocol for a direct reimbursement mechanism.  The commission shall consist of the following members: 2 members of the senate, 1 of whom shall serve as co-chair and 1 of whom shall be appointed by the minority leader; 2 members of the house of representatives, 1 of whom shall serve as co-chair and 1 of whom shall be appointed by the minority leader; the commissioner of the department of revenue; a member of the underground storage tank board; the executive director of the 21J fund; and 1 member appointed by the governor from the executive office of administration and finance.

    

The commission shall report its findings, including any proposed legislation, to the chairs of the senate and house committees on ways and means, the senate and house chairs of the joint committee on revenue and the executive office of administration and finance no later than June 1, 2021.
