An Act prohibiting the use of residential automatic pesticide misting systems.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 132B of the General Laws is hereby amended by inserting after section 16 the following section:-

Section 17. (a) As used in this chapter, the following words shall have the following meanings unless the context clearly requires otherwise:

"residential automatic pesticide misting system," any device that is designed to be installed on, near or around the exterior of any residential dwelling or the grounds of such residential dwelling and to automatically spray any pesticide solution at timed intervals.

(b) No  person  shall  install  or  utilize  any  residential  automatic pesticide  misting  system  in  this  state.

(c) The Commissioner of the Department of Energy and Environmental Protection may adopt regulations to implement the provisions of subsection (a) of this section.  Such regulations may include, but shall not be  limited to, the  establishment  of  a  fine  for  the  violation  of  subsection  (a)  of  this section.
