SECTION 1: Section 10J of Chapter 118e of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after the first paragraph the following new paragraph:-
The division shall provide coverage for drug treatments for antiretroviral regimens used in the treatment of patients with HIV and AIDS that is no more restrictive than the coverage provided by the Massachusetts HIV Drug Assistance Program. The division shall provide coverage for new antiretroviral regimens approved by the United States Food and Drug Administration no later than 30 days after the final coverage determination by the Massachusetts HIV Drug Assistance Program. The benefits in this section shall not be subject to utilization management tools, including prior authorization, or step edits for any antiretroviral regimen greater than what is being utilized by the Massachusetts HIV Drug Assistance Program.
