Chapter 132B of the General Laws is hereby amended by adding the following section:-
Section 16. (a) A property owner who applies a pesticide outdoors shall display at least 1 warning flag for at least 24 hours following each outdoor pesticide application, or longer if suggested or required by the manufacturer's label. All flags shall be posted at the time of the pesticide application.
Warning flags shall be placed within or along the perimeter of the area where pesticides will be applied. Warning flags shall be placed so as to be clearly visible to persons immediately outside the perimeter of such property. Such warning flags shall be posted at least 12 inches above the ground and shall be at least 4 inches by 5 inches in size. Warning flags shall include the following statement: “WARNING, PESTICIDES APPLIED”.
(b) A manufacturer or producer that sells general use pesticides to the public for residential outdoor application shall attach to any retail product containing pesticides 2 warning flags that shall be at least 4 inches by 5 inches in size. Warning flags shall include the following statement: “WARNING, PESTICIDES APPLIED”.
(c) Any retailer that sells general use pesticides to the public for residential outdoor application shall provide for sale to the public pesticide warning flags that shall be at least 4 inches by 5 inches in size. Warning flags shall include the following statement: “WARNING, PESTICIDES APPLIED”.
