An Act relative to motorized shopping carts.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 184B of Chapter 94, as appearing in the 2018 Official Edition, is hereby amended by striking out in line 1 the figures “184E” and inserting in place thereof the following figures:- “184F.”

SECTION 2. Said section 184B of said Chapter 94, as so appearing, is hereby further amended by inserting after the definition “Loyalty Card” the following definition:-

“Motorized cart,” any mobility device powered by batteries, fuel, or other engines that is used by individuals with mobility disabilities for the purpose of locomotion, whether or not it has been designed primarily for use by individuals with mobility disabilities, with an attached basket.

SECTION 3. Said Chapter 94 is hereby further amended by inserting after section 184E the following section:-

Section 184F. Any food store or warehouse club in the Commonwealth shall provide one motorized cart for customer use per 9,000 square feet of retail space.
