An Act relative to internet speed during the COVID-19 outbreak.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide forthwith for the protection of reliable access to high-speed internet during the COVID-19 pandemic, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
(a) As used in this section, the following words shall, unless the context clearly requires otherwise, have the following meanings:-
“Internet service provider”, a person who provides internet access to customers in the commonwealth.
“State of emergency”, the state of emergency related to the outbreak COVID-19 in Massachusetts, declared by the governor pursuant to executive order 591 or any subsequent related order.
(b) Notwithstanding any general or special law to the contrary, all Internet service providers shall provide all residential customers in the commonwealth with the highest bandwidth possible during the state of emergency in the manner that best ensures reliable internet access so all residential customers may telework and connect during the state of emergency.
(c) An Internet service provider shall not be required to adopt, create or implement new technology or build or implement new infrastructure to comply with subsection (b).
