An Act relative to a COVID-19 presumption for public employees.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 1:- Notwithstanding any general or special law to the contrary, any employee of the Commonwealth or its political subdivisions who was required to work during the Massachusetts state emergency related to COVID-19 declared on March 11, and required to report to a work location outside of their home, who contract, have symptoms of or otherwise becomes affected with the Coronavirus (COVID-19), that results in a period of hospitalization, quarantine, or require self-quarantined measures as a result of being infected or coming into contact with someone who is infected with this virus, shall have their medical condition or incapacity to work presumed to be work- related.
Section 2:- Any employee of the Commonwealth or its political subdivisions who was required to work during the Massachusetts state emergency related to COVID-19 declared on March 11, and required to report to a work location outside of their home and who dies as a result of work-related COVID-19 shall be eligible for benefits under section 100 and 100A of Chapter 32 of the General Laws.
Section 3:- This act shall take effect upon passage.
