An Act relative to Massachusetts-manufactured face coverings (“masks”).

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide residents of the commonwealth with access to face coverings for protection during the COVID-19 public health crisis, as advised by the governor on April 10, 2020, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public health and convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 111 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by adding after section 5A1/2 of the following section:-

Section 5A3/4. (a) The department shall contract with manufacturers to produce cloth face coverings for purchase by the department; provided, that said manufacturers are registered with the secretary of the commonwealth as having a principal place of business in the commonwealth; provided further that said face coverings are produced in accordance with guidelines from the Centers for Disease Control and Prevention. Manufacturers whose employees have a union contract shall be prioritized for the purpose of this legislation.

(b) The department shall purchase cloth face coverings from manufacturers in accordance with section 5A.

(c) The department, in coordination with Massachusetts Emergency Management Agency, shall distribute cloth face coverings to local Emergency Management Directors or local health officers for use by municipal employees and residents.
