In the One Hundred and Ninety-First General Court
(2019-2020)
_______________
An Act relative to municipal enforcement of COVID-19 safety regulations.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to permit municipalities to enforce safety standards during the COVID-19 pandemic in the commonwealth, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public health.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding sections 8A and 20 of chapter 639 of the acts of 1950, or any other general or special law, a local health director or other enforcement agent of the local board of health may order the immediate closure of businesses and other organizations and places of worship, as those terms are set forth in the governor’s May 18, 2020 COVID-19 Order No. 33, for up to 10 calendar days upon finding that they are not in compliance with workplace safety rules and standards issued or maintained pursuant to the governor’s May 18, 2020 COVID-19 Order No. 33 and future orders outlining future phases of the state’s reopening plan. The closure order may be appealed to the local board of health.
SECTION 2. This act shall expire upon the termination of the governor’s March 10, 2020 declaration of a state of emergency to respond to COVID-19.
