An Act relative to a perpetual conservation restriction in the town of Middleborough.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. (a) Notwithstanding any general or special law to the contrary, the town of Middlborough, acting by and through its board of selectmen and/or conservation commission, may convey to the Nature Land Conservancy, Inc. and The Archaeological Conservancy, Inc. for no consideration a perpetual conservation restriction pursuant to sections 31 to 33, inclusive, of chapter 184 of the General Laws for the preservation of the water supply, fish and wildlife conservation, native habitat protection, forest management, passive recreation and other consistent purposes in certain parcels of land identified in subsection (b) upon such terms and conditions as the board of selectmen and/or conservation commission, shall determine to be appropriate.

(b) The parcel of land to be subject to the conservation restriction pursuant to subsection (a) is identified as follows: (i) all of the land in the town of Middleborough along the Nemasket River at Ja Mar Farm recorded in certain orders of taking and deeds in the Plymouth County registry of deeds in: book 38629, page 098.

SECTION 2. This act shall take effect upon its passage
