An Act relative to retirement benefits for Thomas Brian Donnelly.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law, rule or regulation to the contrary, the teachers’ retirement board shall grant Thomas Brian Donnelly 1 year of creditable service in the teachers’ retirement system upon payment into the annuity savings fund of the system of an amount equal to 11 per cent of his last annual rate of salary immediately before retirement.
SECTION 2. Notwithstanding any general or special law, rule or regulation to the contrary, upon the grant of 1 year of creditable service pursuant to section 1, Thomas Brian Donnelly shall be considered eligible for the alternative superannuation retirement benefit provided pursuant to subdivision (4) of section 5 of chapter 32 of the General Laws. The board shall then recalculate Thomas Brian Donnelly’s superannuation retirement allowance using the formula for the alternative superannuation retirement benefit, and he shall be considered entitled to the alternative superannuation retirement benefit retroactively to the date of his superannuation retirement.
