An Act relative to allergens in cosmetic products.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 94, as appearing in the 2016 Official Edition, is hereby amended by inserting at the end thereof of the following section:-
“Section 330. (a) The Department shall study and report to the Joint Committee on Public Health potential methods for requiring the disclosure of allergens in cosmetic products offered for retail sale in the Commonwealth, or for otherwise reducing the prevalence of allergic reactions to cosmetic products in the Commonwealth. The report shall be submitted by January 1, 2020.
(b) No manufacturer or distributor may distribute or offer for retail sale cosmetic products in the Commonwealth which indicate the product is hypoallergenic unless the manufacturer has submitted an explanation of how the product is hypoallergenic to the Department of Public Health. The Department may promulgate regulations to implement the provisions of this paragraph.”
