An Act relative to solar systems on land owned by municipalities or other governmental entities within Barnstable and Dukes Counties.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 5 of Chapter 59 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting the following clause after the Forty-fifth A clause:-
Forty-fifth B, A solar powered system that is located on land owned by a municipality in Barnstable or Dukes Counties and that generates solar power that is distributed in kind or in value to the municipality in which it is located, or to another governmental entity within the same municipality, or to another municipality or governmental entity within a cooperative organized pursuant to section 136 of Chapter 164 of which the municipality in which the system is located is a member.
