An Act relative to notification of landowners impacted by state transportation projects.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 5C of chapter 79 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after the word “taken.”, in line 11, the following sentence:-
Said provisions shall apply to takings authorized by the department of transportation and, in the event a plan has been prepared for a new highway, alteration, relocation, specific repair, discontinuance or discontinuance of maintenance the department shall, at least seven days before a public hearing, mail to the recorded owners of land, subject to a taking because of such new highway alteration, relocation, specific repair, discontinuance or discontinuance of maintenance, a notice of the proposed taking and the time and place of such hearing.
