An Act relative to land taking appraisals.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 12 of Chapter 79 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting, after the word “inclusive.” in line 26, the following:-

“An appraisal made in accordance with this section shall account for any injury as is special and peculiar to such parcel, including any injury to fixtures and infrastructure located both above and below ground and contained within the parcel, and the appraisal shall reflect any foreseen costs or expenses to move, replace, or alter any such fixtures and infrastructure as needed to maintain the economic viability of the parcel and its original use.”

SECTION  2. This act shall go into effect immediately upon its passage.
