An Act to increase competition and reduce costs for constructing water treatment plants.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 44D½ of chapter 149 of the general laws, as appearing in the 2016 Official Edition, is hereby amended by striking subsection (j) and inserting the following new subsection in place thereof:-

“(j) Regulations and procedures shall be promulgated by the commissioner of the division of capital asset management and maintenance to implement this section and to ensure that the prequalification process set forth in subsections (a) to (i), inclusive, is sufficient, fair and consistent; provided further, that the aforementioned regulations and procedures established for prequalifying contractors for work on water treatment plants shall require a general contractor to have experience constructing, modifying or repairing a water treatment plant within the past ten (10) years to responsibly maximize the number of qualified contractors for this type of work.”
