To the Honorable Senate and House of Representatives,

 

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing for your consideration the attached legislation entitled “An Act Validating the Results of the Annual Town Election Held in the Town of Heath on May 10, 2019.”

I am filing this special legislation on behalf of the Heath Select Board.

The legislation ratifies all acts, proceedings, and votes taken by the Town of Heath at its recent annual town election.  Of particular importance, the bill certifies the validity of a vote taken that day in connection with the Town’s efforts to secure bond financing for construction of a Town-owned broadband project.  This bill eliminates any potential concern that could be raised during the financing process regarding a minor oversight in the form of advance notice published for that question.

I urge your prompt consideration and passage of this bill in order to facilitate the Town’s financing of this important project.

An Act validating the results of the annual town election held in the town of Heath on May 10, 2019.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding section 64 of chapter 54 of the general laws, or any other general or special law or town by-law or charter provision to the contrary, all acts and proceedings taken by the Town of Heath at the annual town election held on May 10, 2019 and all actions taken pursuant thereto are hereby ratified, validated and confirmed, notwithstanding the omission of the ballot question from the warrant for said election. 

SECTION 2. This act shall take effect upon its passage.
