An Act to authorize the conveyance by lease or easement and change of use of conservation land in the town of Groton.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, the Town of Groton is authorized to transfer to the care, custody and control of the Select Board of the Town of Groton a parcel of land described below currently held by the Town of Groton Conservation Commission for conservation purposes. Upon such transfer, the Select Board of the Town of Groton is authorized to enter in an agreement with  Reedy Meadow Estates Trust to convey by lease, easement or otherwise a part, portion or all of the aforesaid parcel of conservation land as the Select Board of the Town of Groton deems necessary or appropriate, and that the Select Board of the Town of Groton is authorized to change the use of part, a portion or all of said parcel of conservation land, to the new use of providing stormwater drainage for a residential development known as Reedy Meadow Estates.

SECTION 2. The parcel of land referred to in Section 1 of this Act is Town of Groton Conservation Commission property shown as Town of Groton Assessors Map 228, Parcel 59, being 0.34 acres (15,000 SF) more or less, and as further shown on a plan entitled “Easement Plan in Groton, Massachusetts, Olivia Way, Date: April 9, 2019, Prepared by Land Engineering & Environmental Services, Inc.”

SECTION 3. In consideration for the transfer, conveyance and change of use of part, a portion, or all of said parcel of land as described in Section 1 of this Act, the Select Board of the Town of Groton shall acquire by purchase, gift or eminent domain and shall dedicate for conservation purposes under the care, custody and control of the Town of Groton Conservation Commission pursuant to section 8C of chapter 40 of the General Laws and Article 97 of the Amendments to the Constitution of the Commonwealth, the land  and property shown on a plan entitled “Land Swap Plan, Red Pepper Lane, Groton Massachusetts dated April 23, 2019 prepared by Land Engineering & Environmental Services”, being one (1) property in-fee in Pepperell, MA totaling 0.24 acres (10,686 SF) more or less, and one (1) Conservation Restriction on parcel 229-1 (473 Nashua Road, Groton, MA) totaling 0.14 acres (6,000 SF) more or less for a grand total of 0.38 acres (16,686 SF) more or less. In addition the Select Board of the Town of Groton shall return to the care, custody and control of the Town of Groton Conservation Commission as deemed appropriate by said Select Board, any material part or portion of the land and property described in Section 1 of this Act that is not so conveyed and not so used for such drainage purposes.

SECTION 4. This Act shall take effect upon its passage.
