To the Honorable Senate and House of Representatives,

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing for your consideration the attached legislation entitled “An Act Validating Actions Taken in Connection with a Special Town Election in the Town of Oakham.”

I am filing this special legislation at the request of the Oakham Board of Selectmen.

The legislation ratifies all acts, proceedings, and votes taken by the Town at its June 12, 2019 annual Town Meeting and September 12, 2019 special Town election that authorized the Town’s purchase of a dump truck, borrowing to finance the purchase of the truck, and exclusion of the borrowing amount from the Town’s levy limit.  The ratification serves to address any question that might arise due to a technical issue with the form of the ballot question that was approved at the Town election to authorize the debt exclusion.

An Act validating actions taken in connection with a special town election in the town of Oakham.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding section 10 of chapter 39, section 64 of chapter 54, or section 21C of chapter 59 of the General Laws, or of any other general or special law to the contrary, all acts, proceedings, and votes taken by the town of Oakham at its June 12, 2019 annual town meeting under article 14 authorizing a borrowing for the purchase of a dump truck subject to a debt exclusion, and at its September 12, 2019 special town election on a ballot question authorizing the amounts needed to purchase such truck outside the levy limit, and all actions taken pursuant thereto, are hereby ratified, validated, and confirmed to the same extent as if the form of the question on the warrant for the September 12, 2019 special election and on the ballot at said election, had contained the statutory form of the question set forth in subsection (k) of section 21C of said chapter 59.

SECTION 2. This act shall take effect upon its passage.
