An Act relative to emergency insulin access.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 112 of the general laws is hereby amended by inserting after section 12D the following new section:-

Section 12D1/2. (a) For the purposes of this section, "Emergency situation" shall mean an event in which authorization for the dispensing of insulin may not be readily obtained from the practitioner.

(b) Notwithstanding any general or special law to the contrary, in an emergency situation, a pharmacist may: (1) dispense up to a seventy-two hour supply of insulin, or (2) dispense greater than a seventy-two hour supply of insulin if the standard unit of dispensing for the drug exceeds a seventy-two hour supply.

(c) The commissioner of the department of public health shall promulgate rules and regulations necessary for the implementation of this section.

SECTION 2. Section 17G of chapter 32A of the general laws is hereby amended by inserting after the word "insulin" in line 12, the following:- "including insulin dispensed in an emergency situation in accordance with section 12E of chapter 112 of the general laws".

SECTION 3. Section 10C of chapter 118E of the general laws is hereby amended by inserting after the word "insulin" in line 11, the following:- "including insulin dispensed in an emergency situation in accordance with section 12E of chapter 112 of the general laws".

SECTION 4. Section 47N of chapter 175 of the general laws is hereby amended by inserting after the word "insulin" in line 20, the following:- "including insulin dispensed in an emergency situation in accordance with section 12E of chapter 112 of the general laws".

SECTION 5. Section 8P of chapter 176A of the general laws is hereby amended by inserting after the word "insulin" in line 19, the following:- "including insulin dispensed in an emergency situation in accordance with section 12E of chapter 112 of the general laws".

SECTION 6. Section 4S of chapter 176B of the general laws is hereby amended by inserting after the word "insulin" in line 19, the following:- "including insulin dispensed in an emergency situation in accordance with section 12E of chapter 112 of the general laws".

SECTION 7. Section 4H of chapter 176G of the general laws is hereby amended by inserting after the word "insulin" in line 16, the following:- "including insulin dispensed in an emergency situation in accordance with section 12E of chapter 112 of the general laws".
