From the effective date of this act until the termination of the governor’s March 10, 2020 declaration of a state of emergency, any public or private institution of higher education, or any officer or employee of such an institution, that develops, manufactures, tests or distributes personal protective equipment to provide assistance in response to the novel coronavirus, also known as COVID-19, or the state of emergency shall not be liable in a suit for damages as a result of any act or omission in developing, manufacturing, testing or distributing the personal protective equipment, or resulting from the administration to or the use by an individual, unless the act or omission constitutes willful, wanton or reckless conduct.
