An Act transferring employees of the North Shore Regional 911 Center to the State 911 Department.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to transfer employees of the North Shore Regional 911 Center to the State 911 Department, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Employees of the North Shore Regional 911 Center, employed by the Essex County Sheriff, are hereby transferred to the State 911 Department. Notwithstanding any general or special law or rule or regulation to the contrary, the transfer, including any change in an employee’s title or duties resulting from the transfer, shall not: (i) interrupt an employee’s service; (ii) impair an employee’s seniority, retirement or other statutory rights; (iii) result in an employee’s loss of accrued rights to holidays, sick leave or vacation; or (iv) reduce an employee’s compensation or salary grade. Such employees shall not be considered new employees for salary, wage, tax, health insurance, Medicare or any other federal or state purposes. Upon transfer, the Secretary of Administration and Finance shall become the Employer within the meaning of General Laws Chapter 150E, and the transferred employees shall become members of statewide collective bargaining unit 2, as certified by the department of labor relations. Nothing in this act shall continue any obligation under any expired collective bargaining agreement or any agreement made pursuant to an expired collective bargaining agreement and any such agreement shall expire pursuant to its terms.  Nothing in this section shall be construed to confer upon any transferred employee any right not held immediately before the date of transfer to the State 911 Department or to prohibit any reduction of salary grade, transfer, reassignment, suspension, discharge, layoff or abolition of position not prohibited before such date.
