To the Honorable Senate and House of Representatives,

 

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing for your consideration the attached legislation entitled “An Act Relative To The Swearing In of Elected Officials in the Town of Wayland.”

I am filing this special legislation at the request of the Wayland Board of Selectmen.

This bill will permit officers elected at the Wayland Town election on June 9, 2020 or any subsequent election held during the current state of emergency to be sworn in immediately following their election notwithstanding a provision in the Town Charter that provides that terms of office for newly elected officers shall begin only on adjournment of the first annual Town Meeting following the election.  This change is necessary because Wayland has deferred its annual Town Meeting as a consequence of the coronavirus.

Senate, August 27, 2020 -- Message from His Excellency the Governor (under Section 8 of Article LXXXIX of the Amendments to the Constitution) recommending legislation relative to the swearing in of elected officials in the town of Wayland.

An Act relative to the swearing in of elected officials in the town of Wayland.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide an immediate swearing in for elected officials in the town of Wayland, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding the provisions of chapter 53 of the acts of 2010, or of any other general or special law, charter, or bylaw to the contrary, those individuals elected to various offices at the 2020 annual town election for the town of Wayland and those individuals elected to various offices at any other annual town election held for the town of Wayland during the declared state of emergency due to the novel coronavirus COVID-19 that delays the date of the annual town meeting past June 30, 2020, shall be sworn into office as soon as practical following the date of said elections, and the terms of any incumbents shall thereupon terminate.

SECTION 2.  This act shall take effect immediately upon passage.
