An Act relative to special police officers in the city known as the town of Randolph.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding the provisions of Chapter 268A of the General Laws or any other general law, special law, local ordinance or local charter provision to the contrary, the Town Manager of the city known as the Town of Randolph may, as the appointing authority, appoint elected officials in the city known as the Town of Randolph to simultaneously serve in the position of Special Police Officer in the city knows as the Town of Randolph and said elected officials may work and be paid as Special Police Officers on the same terms and conditions as other Special Police Officers in the city knows as the Town of Randolph and subject to the same qualification requirements as other Special Police Officers in the city known as the Town of Randolph.
SECTION 2. An elected official who is appointed as a Special Police Officer pursuant to this act shall, when performing the duties of a Special Police Officer, have the same power to make arrests, and perform other police functions as any other Special Police Officer of the city known as the Town of Randolph.
SECTION 3. An elected official who is appointed as a Special Police Officer pursuant to this act shall, shall be appointed to serve at the pleasure of the Town Manager for an indefinite term, subject to suspension or removal by the chief of police with approval of the Town Manager at any time, with or without cause, with a 14-day written notice.
SECTION 4. A special police officer appointed pursuant to this act shall be subject to the rules, regulations, policies, procedures and requirements of the town manager and chief of police applicable to special police officers including, but not limited to: (i) restrictions on the type of detail assignments; (ii) requirements regarding medical examinations to determine continuing capability to perform the duties of a special police officer; (iii) requirements for training; (iv) requirements for firearms licensing and qualifications; (v) requirements for maintaining a medical or liability insurance police; and (vi) requirements regarding uniforms and equipment.
SECTION 5. Special police officers appointed under this act shall not be subject to chapter 31 of the General Laws or chapter 150E of the General Laws.
SECTION 6. Special police officers appointed under this act shall be subject to sections 100 and 111F of chapter 41 of the General Laws. The amount payable under section 111F of said chapter 41 shall be calculated by averaging the amount earned over the prior 52 weeks as a special police officer working police details, or averaged over such lesser period of time for any officer designated as a special police officer less than 52 weeks before the incapacity. In no event shall payment under said section 111F of said chapter 41 exceed, in any calendar year, the limitation on earning contained in paragraph (b) of section 91 of chapter 32 of the General Laws. Payment under said section 111F of said chapter 41 shall terminate in accordance with said section 111F or at the conclusion of the employment term, whichever occurs sooner. Special police officers appointed under this act shall not be subject to sections 85H or 85H1/2 of said chapter 32 of the General Laws and shall not be eligible for any benefits pursuant to said sections 85H or 85 H1/2 of said Chapter 32.
SECTION 7. Appointment as a special police officer under this act shall not entitle the appointee to assignment to any detail.
SECTION 8. This act shall take effect upon its passage.
