An Act to relative to charter school reimbursements.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 89 of Chapter 71 of the General Laws, as so appearing, is hereby further amended in subsection (gg) by inserting the figure “(1)” immediately before the word “Any” in line 747 and by inserting at the end of the subsection the following:-

(2) If the amount appropriated is insufficient to fully fund all reimbursements required by (gg)(1) of this section, the department shall fund the reimbursements in accordance with the following priorities: (i) the per-pupil capital needs component; and (ii) the 100 per cent increase reimbursement for the first year.

(3) If the amount appropriated is insufficient to fully fund all reimbursements required by (gg)(2) of this section, the total amount calculated to fund a particular charter school pursuant to the provisions of subsection (ff) of this section shall be deducted by the amount that a public school district is not reimbursed for a child’s relocation to said charter school due to insufficient appropriations.
