An Act relative to sexual harassment.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 1 of chapter 151B of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after the word “receivers,” in line 4, the following words:- professional investors, as defined in section 1 of chapter 40G.

SECTION 2. Said section 1 of said chapter 151B, as so appearing, is hereby further amended by inserting after the word “employ”, in line 18, the following words:- and less than 1 million dollars in assets under management.

SECTION 3. Said section 1 of said chapter 151B, as so appearing, is hereby further amended by inserting after the word “decisions”, in line 148, the following words:- or as a basis for business investment transactions, including the sponsoring, guaranteeing or granting of funds.

SECTION 4. Section 4 of said chapter 151B, as so appearing, is hereby amended by inserting after subsection 3C the following subsection:-

3D. For any person whose business includes sponsoring, guaranteeing or granting funds or engaging in investment transactions to discriminate against any person in the sponsoring, guaranteeing or granting of funds or making available such funds, because of race, color, religion, sex, gender identity, sexual orientation, which shall not include persons whose sexual orientation involves minor children as the sex object, children, national origin, genetic information, ancestry, age or handicap.

SECTION 5. Said section 4 of said chapter 151B, as so appearing, is hereby further amended by striking out subsection 16A and inserting in place thereof the following subsection:-

16A. For an employer, personally or through its principals or agents, to sexually harass any employee; provided that, an agent shall include, but not be limited to, professional investors, contractors, bankers, or any other individual who engages in business with such employer.
