An Act reducing tobacco sales to minors.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 6 of Chapter 270 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by striking  subsections (d) and (e) and inserting in place thereof the following subsections:-

(d) Each person selling or distributing tobacco products shall verify the age of the purchaser by means of government-issued photographic identification containing the bearer’s date of birth that the purchaser is 21 years old or older. Verification is required for any person, regardless of age.

(e) A person who violates this section shall be punished by a fine of $1,000 for the first offense, $2,000 for a second offense and $5,000 for a third or subsequent offense.

(f) The department of public health may promulgate regulations to implement this section.
