An Act to create the offense of leaving the scene after causing serious bodily injury.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Subsection (2)(a1/2)(1) of section 24 of chapter 90 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by adding the following sentences:-

“Whoever operates a motor vehicle upon any way or in any place to which the public has a right of access, or upon any way or in any place to which members of the public shall have access as invitees or licensees, and without stopping and making known his or her name, residence and the registration number of his motor vehicle, goes away after knowingly colliding with or otherwise causing injury to another person resulting in the serious bodily injury of that person, shall be punished by imprisonment in the state prison for not more than 5 years, or by imprisonment for not less than 6 months nor more than 2 and 1/2 years in a jail or house of correction and by a fine of not less than $500 nor more than $1,000.  For the purpose of this section the term ‘serious bodily injury’ shall have the same meaning as in section 24L(3) of chapter 90 of the General Laws.”.
