An Act relative to temporary guardians.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 5-305 of Chapter 190B of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by adding, after the word "person." in line 3, the following:-

The reasonable expenses of such appointed guardian, including compensation and counsel fees, shall be determined by the court and paid as it may order, either out of the estate or by the plaintiff, petitioner or the commonwealth.

SECTION 2. Section 5-308 of said Chapter 190B of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by adding, after the word "periods." in line 24, the follow:-

The reasonable expenses of such temporary guardian, including compensation and counsel fees, shall be determined by the court and paid as it may order, either out of the estate or by the plaintiff, petitioner or the commonwealth, for each 90 day period.
