An Act relative to the defense of private property rights through the prevention of abusive eminent domain takings in the Commonwealth.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 79 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by inserting after section 1 the following new section:

“Section 1A. Notwithstanding any general or special law to the contrary, any agreement for damages from an eminent domain taking— for private or commercial investment— must award a minimum of two hundred percent of fair market value for the parcel of land.”

SECTION 2. This act shall take effect upon its passage.
