An Act relative to the Uniform Probate Code.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 190B of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by striking out section 2-517 and inserting in place thereof the following section:
Section 2-517. [Penalty Clause for Contest.]
A provision in a will purporting to penalize an interested person for contesting the will or instituting other proceedings relating to the estate is unenforceable if probable cause exists for instituting proceedings.
